Welcome to SPRK Dating! By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully. If you don't agree, please don't use SPRK.
To use SPRK, you must:
- Be at least 18 years old (or legal age of majority in your jurisdiction)
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using the service under applicable laws
- Not have been previously banned from SPRK
- Comply with all local laws regarding online conduct and dating services
By creating an account, you represent and warrant that you meet these requirements.
Creating an Account
- Provide accurate, current, and complete information
- Use your real name and photos (no fake profiles)
- Maintain only ONE account per person
- Keep your password secure and confidential
Account Security
You're responsible for all activity on your account. If you suspect unauthorized access, notify us immediately at support@trysprk.com.
You may NOT:
- Harass, bully, stalk, or intimidate other users
- Use hate speech or discriminatory language
- Share sexually explicit or pornographic content
- Solicit money or engage in commercial activity
- Impersonate others or create fake profiles
- Share personal information of others without consent
- Use bots, scripts, or automated tools
- Scrape or collect user data
- Promote illegal activities
- Spam or send unsolicited messages
- Attempt to hack or compromise the platform
Violation of these rules may result in immediate account termination and legal action.
Your Content
You own the content you post (photos, messages, bio). By posting, you grant SPRK a worldwide, non-exclusive license to use, display, and distribute your content within the service.
Content Guidelines
All content must:
- Be appropriate and family-friendly
- Not infringe on others' rights
- Comply with our Community Guidelines
- Be original or properly licensed
Content Moderation
We reserve the right to review, remove, or refuse any content that violates these Terms or our Community Guidelines.
Premium Subscriptions
Premium features require a paid subscription. Subscriptions automatically renew unless cancelled before the renewal date.
Cancellation
You can cancel anytime through your account settings. Cancellation takes effect at the end of your current billing period. No refunds for partial months.
Refunds
All sales are final. We don't offer refunds except as required by law or in cases of billing errors.
Tokens
Tokens are virtual items with no real-world value. They cannot be exchanged for cash and are forfeited upon account closure.
By using SPRK and its safety features, you explicitly consent to the following:
Panic Button & Emergency Alerts
SPRK includes a Panic Button feature designed for use during in-person meetups or situations where you feel unsafe. When you activate the Panic Button, SPRK will collect and transmit your real-time GPS location, your profile information (name, email, photo, age), and the profile information of any match or date you have identified — to your designated emergency contacts.
Data Shared with Emergency Contacts
- Your full name, email address, and SPRK user ID
- Your real-time GPS location at the time of the alert
- The name, email, profile photo, and SPRK ID of the person you identified as your date
- The date and time of the alert
Law Enforcement Disclosure
All Panic Button activations are logged by SPRK as a critical safety record. SPRK may share this record — including both users' profile information, location data, and match history — with law enforcement agencies or emergency services if required by court order, legal process, or if SPRK reasonably believes disclosure is necessary to protect the safety of any person.
Your match or date partner's information may be disclosed to police without their separate consent in genuine emergency situations. All users of SPRK agree to this possibility by creating an account.
Your Consent
By creating a SPRK account and using our platform — including meeting other users in person — you consent to SPRK collecting, storing, and disclosing your profile data and location in emergency situations as described above. This consent applies to all users you connect with on SPRK.
Please understand:
- No Guarantees: We don't guarantee you'll find a match or relationship. Dating success depends on many factors beyond our control.
- User Conduct: We're not responsible for other users' behavior, offline meetings, or any harm that may result.
- Safety: While we implement safety features, we cannot guarantee your safety. Always practice safe dating habits.
- "As Is" Service: SPRK is provided "as is" without warranties of any kind. We don't guarantee uninterrupted or error-free service.
To the maximum extent permitted by law, SPRK and its affiliates shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or goodwill
- Personal injury or property damage
- Actions or conduct of other users
- Third-party content or services
Our total liability to you for any claim shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.
Your Right to Terminate
You can delete your account anytime through Settings.
Our Right to Terminate
We may suspend or terminate your account at any time, with or without notice, for any reason, including Terms violations, suspicious activity, or safety concerns.
Effect of Termination
Upon termination, you lose access to your account and all content. Some provisions (liability, disputes) survive termination.
If you have a dispute with SPRK, please contact us first at legal@trysprk.comto try to resolve it informally.
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions.
By using SPRK, you agree to resolve disputes through binding arbitration (where permitted by law) rather than in court, except for small claims disputes.
We may update these Terms from time to time. We'll notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance of the new Terms.
